Acceptance Of The Terms Of Use

This website https://www.imandevelopers.com (the “Website”), is owned and operated by IMAN DEVELOPERS LLC (which term includes all entities of IMAN Developers LLC) (“Iman,” “Company,” “we,” or “us”). The following Terms and Conditions, together with any lease or sale and purchase agreement entered into with the Company or any of its affiliates relating to a residential or commercial unit in an IMAN Developers LLC project (the “Property Agreement”) and any documents incorporated by reference (collectively, the “Terms of Use”), govern your access to and use of the Website, including all content, features, and services offered on or through the Website, whether as a guest or registered user.

Please read these Terms of Use carefully before using the Website. By using the Website, or by clicking to accept or agree to these Terms of Use when such an option is provided, you acknowledge and agree to be bound by these Terms of Use and our Privacy Policy, available at https://www.imandevelopers.com and incorporated herein by reference. If you do not agree to these Terms of Use or the Privacy Policy, you must not use the Website.

Online Purchases And Other Terms And Conditions

All purchases made through the Website, and any transactions for the sale of products or services initiated through the Website or resulting from your visits to the Website, are governed by these Terms of Use and the applicable Property Agreement.

Additional terms and conditions may apply to specific sections, services, or features of the Website. All such additional terms are incorporated into these Terms of Use by reference.

All payments made through the Website are subject to these Terms of Use and the Property Agreement. The Company is under no obligation to accept any payment not made in accordance with these Terms of Use or the Property Agreement, or made after termination of either. You acknowledge that any payment received through the Website shall not be deemed acceptance of such payment nor a waiver of the Company’s right to reject the payment at a later date.

The Website may be used to make payments for expressions of interest or booking fees for reserving a property (commercial, residential, retail, or office). Payment of a booking fee reserves the unit but does not create any legally binding obligation or Property Agreement unless and until a formal Property Agreement is executed between you and IMAN Developers LLC. All expressions of interest are refundable until the unit is allocated, subject to applicable deductions (if any) and as per the EOI terms and conditions mentioned in the EOI form in the event of cancellation.

In the event of cancellation for any reason, including failure to make required payments or failure to sign the required Property Agreement any booking confirmation or receipts issued for the Unit will be forfeited and deemed invalid, and IMAN Developers LLC reserves all rights to the Unit.

The booking fee may be transferred to a third party in the event of a name change or resale (subject to purchaser and management approval). The purchaser remains responsible for complying with all applicable laws and regulations.

All transactions are processed in AED, unless stated otherwise. It is your responsibility to ensure timely and accurate payment. The Company accepts no liability for incorrect, rejected, or declined payments and is under no obligation to notify you of such issues. You must ensure that your payment method has sufficient credit. In the event of a declined transaction, you are responsible for any fees charged by your financial institution or the Company, and the outstanding amount will remain due. You must notify the Company immediately of any failed transaction or technical issue encountered on the Website.

If a transaction is incorrect, unauthorized, or fraudulent, the payment may be reversed, and the payment will still be considered due. Payment transactions will be processed within 48-72 hours of submission, excluding weekends or non-working days, in which case processing will occur within 48 hours of the next working day. A receipt will be issued upon confirmation that funds have cleared into the Company’s bank account. The Company disclaims all liability for any processing delays. Payment is not deemed accepted until funds have cleared.

You are responsible for ensuring the accuracy and completeness of all information provided during payment. If payment is made on behalf of a third party, valid authorization documentation must be provided. Failure to provide accurate information or documentation may result in the payment not being allocated, rejection of receipts or refunds, or cancellation of the booking in accordance with the Property Agreement.

All card payments including but not limited to American Express, Visa, and Mastercard payments may incur additional charges when used for payment through the Website. However, there are no charges on the first AED 50,000 paid via the Website, payment link, or POS machine (one time only) to Iman Developers LLC. A fee of 2.75% will apply to any amount exceeding AED 50,000.

Any duplicate or excess payments received will be adjusted against future invoices. It is your responsibility to retain documentation evidencing payments made through the Website. In case if after the payment for due diligence further documents are required it will be intimated so that transaction can be processed and inquiry can be completed.
